Summary of Indiana Law

  • Indiana law is set out in Indiana Code 27-8-14.2

  • Covers any health or accident insurance policy that is issued on a group basis

  • Excludes self-insured companies

  • Provides coverage for threatment that is prescribed by the insured's treating physician in accordance with a treatment plan.  The insured must submit a treatment plan to his/her insurance provider

  • The Indiana Department of Insurance has stated that Applied Behavior Analysis (ABA) is not subject to visit limitations

  • The insurance provider has the right to review the plan as to medical necessity

  • The insured has the right to challenge a medical necessity ruling

  • Therapies provided in the public schools cannot be covered
