Summary of Indiana Law

Indiana law is set out in Indiana Code 27-8-14.2

Covers any health or accident insurance policy that is issued on a group basis

Excludes self-insured companies

Provides coverage for threatment that is prescribed by the insured's treating physician in accordance with a treatment plan. The insured must submit a treatment plan to his/her insurance provider

The Indiana Department of Insurance has stated that Applied Behavior Analysis (ABA) is not subject to visit limitations

The insurance provider has the right to review the plan as to medical necessity
-
The insured has the right to challenge a medical necessity ruling
-
Therapies provided in the public schools cannot be covered
